Terms of Service

Draft for review · October 27, 2026

These draft terms describe the basic rules for using Quacko's creator discovery and outreach workspace. They are written for product review and do not yet include finalized company, pricing, or dispute details.

1. The service

Quacko provides tools for account registration, creator search, creator and list management, connected-store information, and outreach workflows. Available features may depend on your plan, connected accounts, platform permissions, and the stage of product development. Screens or features marked as previews or coming soon may not be available for operational use.

2. Eligibility and authority

You must be authorized to act for the business or organization using Quacko and to connect any third-party account you add. By using the service on behalf of an organization, you confirm that you have permission to accept these terms for that organization. Do not use another person's account or connect a store or mailbox without authorization.

3. Registration and account security

Provide accurate registration information and keep your sign-in credentials secure. You are responsible for activity through your account except where responsibility cannot legally be assigned to you. Notify the Quacko team through its designated support channel if you believe an account or connected service has been accessed without authorization.

4. Connected platforms

Connections to TikTok Shop, Google, email providers, or other services are subject to the terms and permissions of those services. You decide which accounts to connect and which features to enable. Access may change or stop if a platform changes its API, permissions, policies, or availability. Quacko cannot guarantee that third-party data is complete, current, or available at all times.

5. Your content and data

You retain responsibility for information you upload, enter, or send through Quacko, including prompts, creator lists, tags, drafts, and messages. You grant Quacko the permissions needed to store, display, process, and transmit that information to provide the features you choose. Do not submit information that you are not permitted to use or that violates another person's rights.

6. Creator outreach and messaging

You are responsible for reviewing recipients, message content, frequency, and any applicable disclosure or consent requirements before sending outreach. Automated or AI-assisted drafts are suggestions, not a guarantee of accuracy or compliance. You must follow applicable laws and the rules of each connected messaging or creator platform, including any rate limits and anti-spam restrictions.

7. Acceptable use

Do not use Quacko to send spam, impersonate others, harass creators, collect information without authority, interfere with the service, bypass access controls, or attempt to reverse engineer protected parts of the software. Do not use the service for unlawful or deceptive activity. Quacko may restrict access when reasonably needed to protect the service or other users.

8. AI and third-party information

AI-generated results, creator metrics, and platform-supplied information may contain errors or become outdated. Use your own judgment before making business decisions or sending messages. Quacko does not independently verify every creator profile, metric, or generated recommendation. Third-party services remain responsible for their own products and content.

9. Product changes and availability

Quacko may update features, fix defects, or pause parts of the service for maintenance or security reasons. A preview or trial may have different limits from a paid plan. Any promised uptime, support response time, or notice period must be defined in a separate confirmed agreement; none is promised in this draft.

10. Plans and payment

If Quacko offers paid plans, the price, billing interval, renewal rules, cancellation process, taxes, and any refund terms should be shown at purchase or in an agreed order form. This draft does not establish a price, automatic renewal, refund restriction, or subscription commitment. Those commercial terms must be finalized before charging customers.

11. Intellectual property and feedback

Quacko and its licensors retain rights in the application, branding, and software. These terms give you a limited right to use the service while your account is active; they do not transfer ownership of the platform. You may provide feedback voluntarily. Any rights to use that feedback should be confirmed in the final agreement.

12. Suspension and ending use

You may stop using the service and disconnect supported integrations. Quacko may suspend access for security incidents, misuse, or material violations of the final terms, subject to applicable law and any commercial agreement. The final terms must explain the account closure process, export options, and what happens to stored data after termination.

13. Liability and disputes

The final agreement should address warranties, liability limits, dispute handling, and the law that governs the agreement. These matters depend on Quacko's legal entity, customer locations, and commercial arrangements. This draft intentionally does not select a jurisdiction, require arbitration, or impose a liability cap without that information.

14. Updates and contact

Quacko may revise these terms as the product changes. The finalized agreement should explain when a revision takes effect and how customers will be notified. Before publication, Quacko must add its legal entity, effective date, support contact, and any applicable order form or pricing terms.
